La Cara Ltd – Booking Terms & Conditions
All clients should read this carefully before booking a model.
These conditions are set out by La Cara Ltd Child model and talent agency, Registered UK Company 08732442.
1. 1. La Cara booking form containing details and terms of the shoot must be signed and returned prior to shoot date by the client.
1.2.The client may only use the child model for the purposes set out in the booking form.
1.3.Whilst every endeavour is made to ensure a reliable and efficient service to our clients, we cannot be held responsible for a models conduct on assignments.
2. Permitted use & copyright
2.1. The client has the rights to use one image for one year from the date of the booking, in the UK only, for Permitted use.
2.2. In the event that the Client is not the owner of the copyright, the Client shall procure that the owner of the copyright shall restrict the use of the copyright in any material produced.
2.3. The photographer is not entitled to use any of the images other than what is set out in the booking form by the client. It is the client’s responsibility to draw attention to these terms to the photographer and obtain agreement before the shoot commences.
2.4. Test & experimental photography A Photographer is not entitled to use test and experimental photographs for commercial purposes unless specific arrangements have been made before the photographic session.
3.1. A booking fee will be negotiated between La Cara Ltd and the client and set out on the booking form prior to shoot date.
3.2. Booking fees will be charged by the day or by the hour.
3.3. A two hour minimum booking applies
3.4. Extra minutes are calculated; 0-30 minutes will be charged at a half hour rate, 30-60 minutes will be charged at the full hour rate.
3.5.Overtime rates apply before 9am and after 6pm and any booking over 7 hours.
3.6.Overtime rate is charged at x 1.5
3.7. Special rates can be negotiated for night work 12 am-9am
3.8. Work on Saturdays is the agreed rate x 1.5
3.9 Work on Sundays and bank holidays is the agreed rate x2
3.10. It is not permitted to use the photographs for any use whatsoever until all fees are paid in full.
3.11. All fees are to be negotiated only with La Cara Ltd.
4.1 fitting fees are charged at half the hourly rate with a minimum 2 hour booking
5.1. Additional fees will apply for usage of photographs outside of the UK
5.2. It is the clients responsibility to notify La Cara Ltd if it is anticipated that the territory will need to expand and negotiate additional fees acordingly
6.Agency fees & terms
6.1. Both agency fees and model fees will be invoiced by La Cara, depending on the type of work our agency fees vary from 20% -35%
6.2. Television commercials involving a buy out – The Agency will charge a supplement of 25% on both the shoot fee and the buyout fee. Both the shoot fee and the buy out fee shall be negotiated in respect of each booking at the time of booking.
6.3. Payment is required within 30 days of the date of invoice
6.4. in all cases the person booking the model will be invoiced accordingly, unless otherwise agreed at time of booking.
6.5. La Cara Ltd reserve the right to invoice the ‘ultimate client’ i.e. the manufacturer/owner of the product in question.
7. WEATHER PERMITTING BOOKINGS
7.1. If the Client has notified the Agency that a booking is a weather permitting booking, then at the first cancellation, a half fee is charged unless the client fails to cancel in time to prevent the Models attendance, then the full fee is payable
7.2. In the event that a weather permitting booking is delayed due to weather, the Client may request that the model goes on standby for a maximum of 3 hours. In such event, the model shall remain contactable by telephone and able to go to the shoot immediately on request.
8.1. If a booking is cancelled within 24 hours of the starting time, the full fee will be charged unless the same model is re-booked within 24 hours, in which case half the fee is charged. Saturdays, Sundays and Bank Holidays are excluded from these calculations. However, if a booking is cancelled due to illness or some other reason beyond the models or agencies control (and upon the production of the appropriate evidence) the model shall not be liable for cancellation charges. This is a reciprocal arrangement between models and client.
9.1 Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking, or if a definite booking is offered and the provisional cannot be confirmed.
10.1 The client is responsible for the models health and safety when the model is travelling, or providing services, in connection with the booking.
10.2 The client will maintain adequate insurance cover to underwrite its obligations to the model.
10.3 The agent is not responsible if the model fails to attend the booking. The client is advised to insure against any losses, which might result if the model does not keep a booking because of ill health, or some other reason.
10.4. It is the clients responsibility to arrange insurance if indemnity is required against a models inability to attend through sickness or unforeseen circumstances.
11.1. Clients are responsible for models meals unless otherwise stated at time of booking for model to bring packed lunch.
12.1 Complaints should be reported to La Cara in writing when it arrises.
13.1. Children under 16 years of age require a performance licence.
13.2. It is the clients responsibility to licence the children.
13.3. Licences can take 5-15 days depending on the council in question.
14. Password and Sign in Security
14.1. You are responsible for any use of our on-line service with your password and protecting your password from unauthorised use. You are also responsible for the security of any computer where you choose to remain signed in to lacara.co.uk.
We reserve the right to negotiate with the structure of these Terms and Conditions.
